Why you need a car accident attorney
Rear-end crashes, like all other car accidents, requires you to prove another party is liable for your injuries as part of pursuing an insurance claim or personal injury lawsuit against a negligent party. Although rear-end collisions seem obviously the fault of the driver of the second car, that is not always the case. Even when it is the case, the other driver and the driver’s insurance company may not agree. They may argue that you are partially at fault for the car accident. Under Colorado comparative negligence laws, they can reduce or eliminate your ability to recover compensation if you are partially liable for your own injuries. You need an experienced Denver car accident attorney with Front Range Injury Attorneys to advocate for you and make sure you get the compensation you deserve.
Our knowledgeable Denver car accident lawyers will investigate the collision, determine liability and fight for full and fair compensation for your injuries and damages. We are experienced advocates for clients injured in car accidents with a proven track record of recovering compensation for our clients. What causes rear-end collisions?
Rear-end accidents are a widespread problem in Colorado streets and highways. According to the insurance industry’s own research, there are over 2,200 fatal rear-end accidents nationwide with over 550,000 causing injuries each year. A National Highway Traffic Safety Administration (NHTSA) study concluded the most common causes of rear-end crashes include:
- Distracted driving: driver distraction is a leading cause of rear-end crashes and car accidents in general. Driver distractions include texting and talking on phones, passenger interactions, eating and drinking and daydreaming.
- Tailgating: Following too closely increases the likelihood of a rear-end accident. When the driver in front stops or slows due to traffic conditions or traffic control devices, a tailgating driver has little time to reach.
- Improper lane changes and mergers: Drivers who change lanes or merge with traffic without correct use of turn signals or enough distance for oncoming vehicles can cause rear-end accidents.
- Speeding: The faster a vehicle travels the more distance and time it requires to stop. Speeding lengthens the distance and time necessary for the car to stop. Speeding can contribute to the incidence and severity of a rear-end collision.
Common rear-end accident injuries
Rear-end collisions can cause several types of injuries with a wide range of severity. Often the more severe the crash, the more severe the injuries. Although most passenger cars possess several safety devices to minimize the effects of an impact to the back of your car, injuries occur frequently. Some of the most common rear-end accident injuries include:
- Spinal cord injuries
- Neck injuries (especially from whiplash)
- Head injuries
- Brain injuries
- Lower back injuries
- Shoulder, elbow and wrist injuries
If you suffered injuries due to a car accident, it is important that you receive prompt medical evaluation. You may suffer injuries requiring emergency care. Waiting to obtain an evaluation and diagnosis risks dangerous complications and extends the time you will suffer with the symptoms of injuries.
What do I do after a rear-end auto accident?
There are several steps you should take after a motor vehicle accident.
Be safe. Do not get out of your vehicle unless it is safe. If you feel any new or different sensations, do not move unless staying where you are is dangerous.
Call 911 or the police. If you or anybody else suffered injuries in the collision, call 911. The police can investigate the collision and preserve important evidence of liability. EMTs can provide emergency medical care on the scene and transport victims to the emergency room.
Take pictures. If it is safe for you to move, take pictures of the scene, damage to the vehicles involved and your injuries. If you have a passenger who is able to move, you may need to ask your passenger to take photos.
Exchange insurance information. After a collision, the drivers involved must exchange insurance information and contact information. Provide your insurance and driver’s license and ask for the same. Take photos of the insurance card and driver’s license.
Seek medical attention. As soon as you feel pain or any new sensation, seek emergency care. That may be immediately after the wreck or days later.
